1. Acceptance of Terms

By downloading, installing, or using Flarely ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Flarely.

2. Description of Service

Flarely is a personal health tracking application designed to help users monitor chronic conditions such as IBS, Migraine, and Eczema. The App allows you to:

• Log symptoms, food intake, triggers, sleep, stress, weather, exercise, and medications
• Track Bristol Stool Scale entries (IBS) and menstrual cycle data
• Create custom conditions with fully customizable symptom lists
• Use on-device pattern detection to identify potential correlations between your logged data
• Receive personalized guidance through the Wellness Guide (safe/caution factors) and Flarely Guide (mid-flare advice)
• Detect trigger combinations (e.g., "dairy + poor sleep = flare")
• Generate PDF and CSV reports suitable for sharing with healthcare providers
• Set medication reminders with custom schedules

All health data processing occurs on your device. Flarely does not transmit your health data to any external servers.

3. Medical Disclaimer

Flarely is NOT a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

The App does NOT provide medical advice, diagnosis, or treatment recommendations of any kind. Information provided by the App, including pattern analysis, insights, the Wellness Guide, and the Flarely Guide, is for informational and personal tracking purposes only.

Always consult a qualified healthcare professional before making any decisions about your health, diet, medication, or treatment. Never disregard professional medical advice or delay seeking it because of information presented in this App.

If you are experiencing a medical emergency, call your local emergency services immediately.

4. Pattern Analysis Disclaimer

The pattern detection feature uses statistical correlation analysis performed entirely on your device.

Correlations identified by the App represent statistical associations only and do NOT establish causation.

The accuracy of pattern analysis depends on the quality, consistency, and quantity of data you provide. Pattern-based insights may be incomplete, inaccurate, or misleading. They should never be used as a substitute for professional medical evaluation.

The Wellness Guide and Flarely Guide generate personalized suggestions based on your historical data. These suggestions are statistical summaries of your own logs and are not clinical recommendations.

You acknowledge that the pattern analysis feature is a tool to assist personal tracking and is not a validated clinical instrument.

5. Subscription Terms

• Flarely offers a free tier with core tracking features and a premium subscription with additional features.
• Premium subscription is available at $4.99 per month, $29.99 per year, or $79.99 for lifetime access.
• Premium features include: unlimited conditions, all pattern insights with flare warnings, trigger combination detection, full Wellness Guide and Flarely Guide access, doctor-ready PDF reports, and CSV export.
• Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• Payment is charged to your Apple App Store account at confirmation of purchase.
• You can manage or cancel your subscription through your device's App Store subscription settings.
• Refunds are handled exclusively by Apple according to their refund policies. Flarely does not process refunds directly.
• Prices may change with reasonable notice. Any price change will take effect at the start of your next billing period.

6. Your Data

• You retain full ownership of all health data you enter into the App.
• All health data is stored locally on your device. Flarely does not transmit your health data to external servers.
• You are solely responsible for backing up your data. Flarely provides export features (JSON, CSV, PDF) for this purpose.
• Uninstalling the App will permanently delete all stored data from your device. This action cannot be undone.
• Flarely has no ability to access, recover, or restore your data once it has been deleted.

7. Acceptable Use

The App is intended for personal health tracking by individuals aged 13 and older. You agree not to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Use the App for any purpose that is unlawful or prohibited by these Terms
• Redistribute, sublicense, or commercially exploit the App or its content

8. Limitation of Liability

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. Flarely disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Flarely shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App.

Flarely is not liable for any health decisions, actions, or outcomes resulting from your use of the App or reliance on its features, including pattern analysis.

In no event shall Flarely's total liability exceed the amount you paid for the App in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Flarely, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the App or violation of these Terms.

10. Termination

You may stop using the App at any time by uninstalling it from your device. Uninstalling the App permanently removes all locally stored data.

If you have an active premium subscription, uninstalling the App does not automatically cancel your subscription. You must cancel through your App Store subscription settings.

Flarely reserves the right to modify, suspend, or discontinue the App at any time without prior notice.

11. Changes to Terms

Flarely reserves the right to update or modify these Terms at any time. Changes will be communicated through app updates. The "Effective Date" at the top of this page will be updated accordingly.

Your continued use of the App after any changes constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, you should discontinue use of the App.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Lebanon. Any disputes arising from these Terms or the App shall be subject to the jurisdiction of the courts of Lebanon.

13. Dispute Resolution

Any disputes arising from or relating to these Terms or the App shall first be resolved through informal negotiation by contacting us at support@flarely.me.

If a dispute cannot be resolved informally within thirty (30) days, it shall be settled by binding arbitration in accordance with applicable arbitration rules. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
